How to apply for a US work permit – EAD

The process for applying for a U.S. work permit – called an employment approval document or EAD – is simple and straightforward. All you have to do is fill out a one-page form, attach processing fees, documents and photos that prove your eligibility and everything else is U.S. Submit to Citizenship and Immigration Services (USCIS)

Of course there is a catch though; In this case it ensures that you are indeed qualified. Work permits are only available to a limited group of foreign immigrants, usually those who are applying for status adjustment (a green card) or who already have a temporary right to stay in the United States. How to apply for a US work permit – EAD

Don’t be confused by applying for a work permit and a work visa – such as an H-1B visa. Applying for a work visa is a very complicated process.

The form used to apply for a work permit is Form I-765, which can be downloaded for free on the USCIS website.

Most of the form is self-descriptive. You simply fill in your name, contact information and other details. For Question 12, you will be asked for your recent entry into the United States, even if you have been in the country for some time and come out on a short trip abroad. “Entry Procedure” refers to the visa you entered the country.

Question 16 is probably going to take the most effort. To understand the qualifications section that you have, you need to look at the instructions for the form, which can be found on the USCIS website. The most common categories are Section (a) (5), (i) (12) Temporary Protected Status (TPS) for asylum seekers; (C) (3) (c) Status for students undergoing post-graduate practical training, (c) (5) J-1 exchange visitors for J-2 spouses and (c) (9) Status for applicants for adjustment (green card) .

If the section contains two letters or numbers – such as (c) (9) – do not worry about the three spaces in the form. Enter the number in the second set of blank letters and in the third.

How to add proof of eligibility to a US work permit
To prove your eligibility for a work permit, you will need to make a photocopy of what will be proved by the status described for question 16. For example, if you apply as an asylum seeker, attach the letter from the asylum office or attach the judge’s order attach that Gives you shelter. Instructions for what documents you will need can be found in the form.

Please note that if you are applying for a work permit in addition to a green card or any other type of status, you do not need to include proof of eligibility. USCIS is able to determine your eligibility from other applications you submit.

Attaching the right fee
The fee for a work permit is 4 410 as of 2018, but the fee for USCIS may increase regularly. Double check to see what the current fee is. If you are requesting a deferred action, you will have to pay an additional 85 85 biometrics. Also keep in mind that some department applicants will have a fee waiver such as applying for a green card, as the fee for our work permit is covered by the green card fee. You can pay the fee by check or money order while mailing the application. If the application is sent online, you can pay by debit / credit card or by sending a US check or online checking through a US savings account.

The EAD application is being submitted
There are two ways you can submit the form to USCIS; Either through regular mail or online e-filing on computer. E-filing provides convenient payment options and is also convenient because you can fill out and submit the entire form online. Note that you still need to mail in supporting documents.
